ParkDay Terms of Service

Welcome to ParkDay!

These Terms of Service ("Terms") govern your access to and use of the ParkDay mobile application, website, and related services (collectively, the "Services").

By creating an account or using ParkDay, you agree to these Terms. If you do not agree, please do not use the Services.

Our Goal

ParkDay exists to help people capture, organize, and celebrate their theme park adventures. Whether you're preserving memories, discovering new experiences, or connecting with fellow enthusiasts, we ask that you use the Services respectfully, responsibly, and in a way that contributes positively to the ParkDay community.

1. Eligibility

You must be at least 13 years old, or the minimum age required by law in your country of residence, to create a ParkDay account.

If you are under 18, you represent that you have permission from a parent or legal guardian to use the Services where required by applicable law.

2. Your Account

You are responsible for:

• Maintaining the security of your account.
• Keeping your login credentials confidential.
• Providing accurate and complete information.
• All activity that occurs under your account.

You agree not to share your account with others or impersonate another person.

Notify us immediately if you believe your account has been compromised.

We reserve the right to suspend or terminate accounts that violate these Terms.

3. Community & Acceptable Use

ParkDay exists to help people celebrate and remember their park adventures.

We ask every member of the community to help create a welcoming, respectful, and family-friendly environment.

You agree not to:

• Harass, threaten, stalk, or intimidate others.
• Post hateful, discriminatory, or abusive content.
• Upload pornography, explicit sexual content, or inappropriate nudity.
• Share graphic violence or disturbing imagery.
• Upload spam, scams, phishing attempts, or misleading information.
• Impersonate another individual or organization.
• Violate another person's privacy.
• Upload copyrighted material you do not have permission to use.
• Interfere with the operation or security of ParkDay.
• Use automated bots or scripts without authorization.
• Use ParkDay for unlawful purposes.

ParkDay reserves the right to investigate violations and remove content, restrict features, suspend accounts, or permanently terminate accounts that violate these Terms.

4. Fair Play

ParkDay celebrates genuine park experiences.

To maintain a fair experience for everyone, you agree not to manipulate rankings, achievements, quests, badges, memories, or statistics through deceptive means.

Examples include:

• GPS spoofing
• Fake check-ins
• Artificially inflating statistics
• Automated account creation
• Bot activity
• Multiple accounts created to gain unfair advantages
• Exploiting bugs or unintended behavior
• Manipulating community rankings or leaderboards

If we determine that an account has violated these rules, ParkDay may reset statistics, remove achievements, revoke badges, restrict features, suspend accounts, or permanently terminate access.

5. Your Content

You retain ownership of the photos, reviews, memories, captions, comments, lists, ratings, tips, and other original content you create.

When you choose to publish content publicly, you grant ParkDay a non-exclusive, worldwide, royalty-free license to host, reproduce, display, distribute, and feature that content in connection with operating, improving, and promoting the Services.

This includes:

• Community feeds
• Featured collections
• Editorial selections
• Marketing materials
• Social media
• The ParkDay website
• Presentations
• App Store and Google Play screenshots
• Promotional videos and advertisements

This license allows us to showcase the ParkDay community while you retain ownership of your content.

You may remove public content at any time. Removal will apply to future uses, although previously published materials, backups, archived copies, or cached versions may continue to exist for a reasonable period.

6. User Content & Intellectual Property

You are responsible for ensuring that you have the legal right to upload and share any content submitted to ParkDay.

By uploading content, you represent and warrant that:

• You own the content, or
• You have obtained all necessary rights and permissions to share it.

You may not upload content that infringes another person's copyright, trademark, publicity rights, privacy rights, or other intellectual property.

If ParkDay receives a valid legal request or reasonably believes content infringes another person's rights, we may remove that content without prior notice.

7. Theme Park Intellectual Property & Affiliation

ParkDay is an independent application designed to help users document, organize, and share their personal theme park experiences.

ParkDay is not affiliated with, endorsed by, sponsored by, authorized by, or associated with The Walt Disney Company, Universal Destinations & Experiences, Six Flags Entertainment Corporation, Cedar Fair, SeaWorld Parks & Entertainment, Merlin Entertainments, or any other park owner, operator, or affiliated company unless expressly stated.

All park names, attraction names, hotel names, entertainment offerings, characters, logos, trademarks, service marks, copyrights, and other intellectual property referenced within ParkDay remain the property of their respective owners.

References to parks, attractions, restaurants, hotels, entertainment, and experiences are provided solely for descriptive, informational, historical, and organizational purposes to help users document their personal visits.

Nothing within ParkDay should be interpreted as suggesting sponsorship, endorsement, approval, or affiliation with any theme park operator.

8. Intellectual Property

ParkDay, including its software, branding, logos, illustrations, badges, icons, graphics, design system, original artwork, text, user interface, and other original content, is owned by ParkDay or its licensors and is protected by copyright, trademark, and other intellectual property laws.

Except as expressly permitted by these Terms, you may not copy, reproduce, modify, distribute, reverse engineer, create derivative works from, or otherwise use any part of the Services without our prior written permission.

9. User Feedback

If you submit ideas, feature requests, suggestions, bug reports, or other feedback, you agree that ParkDay may use that feedback without restriction or compensation.

10. AI Features

ParkDay may include AI-powered features that generate summaries, recommendations, captions, search results, or other helpful content.

AI-generated content is provided for convenience and may not always be accurate. You are responsible for reviewing AI-generated content before relying upon it.

11. Premium Features

Some features may require a paid subscription.

Subscription pricing, billing, renewal, cancellation, and refund terms will be presented before purchase.

Subscriptions automatically renew unless canceled through the platform where they were purchased.

Apple App Store and Google Play billing policies apply where applicable.

12. Beta & Experimental Features

From time to time, ParkDay may offer beta, preview, early access, or experimental features.

These features are provided for evaluation purposes and may change, be discontinued, contain errors, or be unavailable at any time.

By choosing to use beta features, you acknowledge that they are provided "as is" and may be modified or removed without notice.

Your feedback regarding beta features helps improve ParkDay, and any feedback you provide may be used by ParkDay without restriction or compensation.

13. Park Safety

Your safety is more important than using ParkDay.

Always follow the instructions of park employees, ride operators, and emergency personnel. Follow all posted safety requirements and park policies.

Do not use ParkDay in a way that distracts you while boarding or exiting attractions, walking in unsafe areas, driving, or during emergencies.

ParkDay is intended to enhance your park experience—not replace your awareness or judgment.

14. Availability

We strive to keep ParkDay available and reliable but do not guarantee uninterrupted or error-free operation.

We may modify, suspend, discontinue, or remove features at any time without prior notice.

15. Reserved Rights

To help keep ParkDay safe, reliable, and enjoyable for everyone, we reserve the right, at our sole discretion and to the extent permitted by law, to:

• Add, modify, suspend, or remove features or functionality.
• Change or discontinue any aspect of the Services.
• Remove, edit, or refuse content that violates these Terms.
• Suspend, restrict, or terminate user accounts.
• Investigate suspected misuse, fraud, abuse, or security issues.
• Reset or remove achievements, rankings, badges, memories, or other in-app progress that we determine was obtained through abuse, software bugs, exploits, or fraudulent activity.
• Limit access to certain features, regions, devices, or accounts when necessary to protect the Services, our users, or comply with legal obligations.

We will exercise these rights in good faith to protect the ParkDay community, maintain the integrity of the Services, and comply with applicable law.

16. Account Suspension & Termination

We may suspend, restrict, or permanently terminate your account if you:

• Violate these Terms.
• Violate applicable law.
• Abuse other users.
• Attempt to compromise the security of ParkDay.
• Create legal or reputational risk for ParkDay or its community.

You may delete your account at any time using the tools provided within the Services.

Termination of your account does not automatically remove content that has already been shared publicly or previously featured in accordance with these Terms.

17. Third-Party Services

ParkDay relies on third-party providers for services including authentication, analytics, hosting, storage, mapping, notifications, payment processing, customer support, and AI features.

Your use of those services may also be subject to their own terms and privacy policies.

18. Copyright Complaints

ParkDay respects the intellectual property rights of others.

If you believe content available through ParkDay infringes your copyright or other intellectual property rights, please contact us at:

Please include:

• Your contact information.
• A description of the copyrighted work.
• The location of the allegedly infringing content.
• A statement that you believe the use is unauthorized.
• A statement made under penalty of perjury that the information provided is accurate and that you are authorized to act on behalf of the rights holder.

Upon receiving a valid notice, we may investigate the claim and remove or disable access to the content while the matter is reviewed.

19. Disclaimers

The Services are provided on an "as is" and "as available" basis.

To the fullest extent permitted by law, ParkDay disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, availability, accuracy, reliability, and non-infringement.

We do not guarantee that:

• The Services will always be available.
• Information provided by users is accurate.
• User-generated content is complete or reliable.
• Attractions, wait times, events, or park information are current or error-free.

Users should always verify important information directly with the applicable park operator.

20. Limitation of Liability

To the fullest extent permitted by law, ParkDay, its owners, employees, contractors, affiliates, licensors, and partners will not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages arising from your use of the Services.

Our total liability for any claim relating to the Services shall not exceed the amount you paid to ParkDay during the twelve (12) months preceding the claim, or $100 USD, whichever is greater, to the extent permitted by applicable law.

Nothing in these Terms limits liability where such limitation is prohibited by law.

21. Indemnification

You agree to defend, indemnify, and hold harmless ParkDay, its owners, employees, contractors, affiliates, licensors, and partners from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from:

• Your use of the Services.
• Your content.
• Your violation of these Terms.
• Your violation of another person's rights.
• Your violation of applicable law.

22. Changes to These Terms

We may update these Terms from time to time.

If material changes are made, we will notify users through the Services or by email when appropriate.

Your continued use of ParkDay after the updated Terms become effective constitutes acceptance of the revised Terms.

The Last Updated date at the top of these Terms will always indicate the most recent revision.

23. Governing Law

These Terms are governed by the laws of the State of Colorado, United States, without regard to conflict of law principles.

Any legal action relating to these Terms shall be brought in the state or federal courts located in Colorado, unless applicable law requires otherwise.
